1. Introduction

Welcome to Spandex Halloween. By accessing this website and purchasing our custom-made products, you acknowledge and agree to these Terms and Conditions. Please read them carefully before placing an order.

2. Governing Law

These Terms shall be governed by and defined following the laws of the jurisdiction in which the Service Provider is legally registered and operates. You irrevocably consent that the courts of said jurisdiction shall have exclusive authority to resolve any dispute which may arise in connection with these terms.

3. Custom Products and Accuracy

Bespoke Nature: All products sold on this site are custom-made to order. They are manufactured based specifically on the measurements and design selections you provide.
Descriptions: We aim for perfection, but we do not warrant that product descriptions, colors, or textures are 100% error-free. Small variations may occur due to the custom manufacturing process.

4. User Communications & Reviews

Transactional Emails: You will receive essential emails regarding your order status, payment, and shipping.
Review Invitations (Opt-In): We only send review invitation emails if you have explicitly agreed to receive them by checking the relevant box during the checkout process. If you did not tick the box, we won’t bug you!
Marketing: You will only receive marketing materials if you have subscribed to our newsletter. You can opt-out of marketing communications at any time.

5. Shipping and Delivery

International Shipping: We ship globally. You, the buyer, are the “importer of record” and must comply with all laws and regulations of the destination country.
Duties and Taxes: You are responsible for any import duties, VAT, tariffs, or taxes required by your country’s customs office.
Timelines: Shipping times are estimates. We are not liable for delays caused by customs clearance or third-party carriers.

6. No Refunds and No Returns

Please Read Carefully:

Custom Policy: Since each costume is custom-made just for you based on your unique specifications, we are unable to offer refunds or accept returns once production has begun.
Exemptions: This policy aligns with international consumer protection standards (including the EU Directive on Consumer Rights) which exempts “goods made to the consumer’s specifications or clearly personalized” from standard right-of-withdrawal periods.
Responsibility: Please double-check your measurements and selections before placing your order! We cannot be held responsible for errors in the measurements provided by the customer.

7. Defective Items

In the unlikely event that you receive a product that is damaged or contains a manufacturing defect (not related to incorrect sizing provided by you), please contact us within 3 days of delivery with photographic evidence. We will review these cases on an individual basis.

8. Intellectual Property

All content on this website, including the Spandex Halloween logo, character designs, text, and graphics, is the exclusive property of Spandex Halloween.
